By accessing or using Collabricate, you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of these terms, you may not use our service.

2. Account Terms

• You must be at least 16 years old to use Collabricate
• You must provide accurate, current, and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You are responsible for all activities that occur under your account
• One account per person - multiple accounts are not permitted
• You must notify us immediately of any unauthorized use of your account

3. Subscription and Payments

Billing

• Collabricate operates on monthly subscription plans
• Payments are processed securely through Stripe
• Subscription fees are charged monthly in advance
• You authorize us to charge your chosen payment method

Refunds and Cancellation

• You may cancel your subscription at any time from your account settings
• Cancellations take effect at the end of your current billing period
• We offer prorated refunds for annual subscriptions cancelled within the first 30 days
• Monthly subscriptions are generally non-refundable, but we may provide refunds at our discretion
• Free trial users may cancel anytime without charge

Price Changes

We may change our pricing with 30 days advance notice. Existing subscribers will maintain their current pricing until their next renewal cycle.

4. Content and Intellectual Property

Your Content

• You retain full ownership of all content you upload to Collabricate
• You grant us a limited license to store, process, and transmit your content solely to provide our services
• You are responsible for ensuring you have the right to upload and share any content
• You must not upload content that violates others‘ intellectual property rights

AI Features

When using AI project suggestions, limited project structure data (folder names, tasks, milestones, user names/IDs) may be shared with OpenAI. You consent to this processing when enabling AI features.

Platform Content

Collabricate and its original content, features, and functionality are owned by us and protected by copyright, trademark, and other laws.

5. Acceptable Use Policy

You agree NOT to use Collabricate for:

• Any unlawful purposes or to violate any applicable laws
• Harassing, abusing, or harming others
• Uploading malicious software, viruses, or harmful code
• Infringing on others‘ intellectual property rights
• Distributing spam, unsolicited messages, or promotional content
• Attempting to gain unauthorized access to our systems
• Reverse engineering or attempting to extract our source code
• Using the platform for competing services or commercial purposes beyond collaboration

6. Storage and File Management

• Storage limits apply based on your subscription plan
• We may compress or optimize files to manage storage efficiently
• You are responsible for backing up important files
• We reserve the right to remove files that violate these terms
• Inactive accounts may have files archived or deleted after extended periods

7. Privacy and Security

• We implement end-to-end encryption for messages and communications
• We do not scan or monitor your uploaded files for content
• Your privacy rights are detailed in our Privacy Policy
• You are responsible for managing access permissions to your projects

8. Service Availability

• We strive to maintain high uptime but cannot guarantee 100% availability
• We may perform maintenance that temporarily affects service availability
• We are not liable for losses due to service interruptions
• We may modify or discontinue features with reasonable notice

9. Account Termination

Your Right to Terminate

• You may delete your account at any time through account settings
• All your data will be permanently deleted within 7 days
• Download any important data before deleting your account

We may suspend or terminate accounts that:

• Violate these Terms of Service
• Engage in fraudulent or harmful activities
• Remain inactive for extended periods (with advance notice)
• Fail to pay subscription fees

10. Disclaimer and Limitation of Liability

Service Disclaimer

Collabricate is provided “as is“ without warranties of any kind. We do not guarantee that the service will be error-free, secure, or continuously available.

Limitation of Liability

To the maximum extent permitted by Spanish law, Collabricate shall not be liable for:

• Any indirect, incidental, special, or consequential damages
• Loss of data, profits, or business opportunities
• Damages resulting from service interruptions or data breaches
• Actions of third parties or content uploaded by users

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Governing Law

These Terms are governed by Spanish law. Any disputes will be resolved in the competent courts of Spain. We will attempt to resolve disputes amicably before pursuing legal action.

12. Changes to Terms

• We may modify these Terms at any time
• Material changes will be communicated via email or platform notification
• Continued use after changes constitutes acceptance
• If you disagree with changes, you may terminate your account
